Elderly Thai Motorbike Taxi Driver Killed by Cement Mixer

An elderly Thai motorbike taxi driver has been killed in a tragic accident with a 10-wheel cement mixer on the Sukhumvit Road Thursday morning.

Pattaya, the 9th of September 2010: At approximately 10:30am on Thursday, Lieutenant Colonel Chatchai Srisuwan (Pattaya Police Investigator) was notified of fatal accident on the Sukhumvit Road at the intersection with South Pattaya Road. A team of officers along with the Sawang Boriboon Foundation were dispatched to investigate.

Arriving at the scene, officers observed a deceased man, Mr. Jumpee Kemthong [70], lying on the road next to the badly damaged remains of a red Honda Wave motorbike. Positioned further up the road was a ten-wheel cement mixer, which collided with the aforementioned bike of Mr. Kemthong.

Rescue personnel stipulated that Mr. Kemthong had died of a severe skull fracture resultant from his heavy impact with the road or truck. The deceased was taken to the Forensic Science Institute for autopsy before being released to his family for funeral proceedings.

The driver of the involved truck, registered to the Baan Amphur Trading Company, Mr. Peeraphol Pohthiworn [25], was waiting at the scene to give police a statement. Mr. Pohthiworn explained that another vehicle had attempted to overtake Mr. Kemthong on his left-hand-side forcing the old man out into the right-lane and under the front wheels of the truck. Mr. Pohthiworn stated that he could not recall any details regarding the other vehicle involved, other than to state that it was a pickup.

Police detained Mr. Pohthiworn, who is now expected to be charged for negligent driving occasion death as a result of the accident.

Cement truck driver, your a lying piece of poo... there are 5 kinds of pickups in thailand.. 70% of them are toyota's.. all thai men know the pickups, brands, styles, etc... he was travelling way too fast and f'd up... the drivers in thailand are horrendous!!!

Sounds like Khun Jumpee was stuck into the proverbial rack and a hard place. An overtaking pickup squeezes him oncoming traffic and certain death. The alternative would have been to stay in the center of his lane and had the pickup rear end him. This is a sad situation.

Responsibility for one's action appears to have no value in Thai traffic laws. If indeed the bike driver swerved in front of the cement truck, most countries would consider this as "improper lane change", and the fault of the loss of life would lie with the deceased. It's my understanding that in all cases involving a motor bike fatality, Thai traffic laws require the car/truck operator to be charged with the accident, irregardless of who actually is responsible. So, if you're sitting still waiting for a stop light to change, a speeding drunk bike driver crashes into the back of your car and kills himself, YOU will be charged as causing the accident, and required to make restitution to the drunk's family.
