Pattaya, the 16th of February 2010 [PDN]: Police investigators performed the DNA testing on over 600 employees at the Allied Precision Company based on the belief that the murderer had intimate knowledge of the family and the fact that a substantial amount of money was kept at the family-run fishing business where the murders took place.

Since his arrest, Mr. Yuenyaw has claimed that he is a drug addict and was in serious financial trouble with various money lenders. He has explained that on the day of the murder he had gone to the fishing shop, owned by his colleague and friend and asked to use the toilet. Whilst Mrs. Jaila and her daughter were watching television, he emerged from the toilet to attack the pair before stealing the 20,000 baht and proceeding to work.
Mr. Yuenyaw has stated that he used the money to purchase drugs and alcohol as well as pay off some of his debts, continuing to work with and consol the grieving Mr. Jitsanguan.
Chon-Buri Criminal Court sentenced Mr. Yuenyaw to death on Tuesday, in accordance with criminal law act 289(7), 339. The court ruling also stipulated that an amount of 20,300 baht be re-reimbursed to the victim’s husband.

Used to be a drunk drivers legal defense was "being drunk" and thereby not responsible for injuries/deaths.

The thing is that I do understand your point view. It is dictated by emotion and if I would have been in that very same situation (as you point out) my emotions would run wild too. But, still I think that that boy is also a victim, victim to his addiction. I had to defend people like him in court and I do assure you that sometimes it is very hard to assume the defense in that sort of case where emotions run high. Justice, according to human nature and law are sometimes and very often on the opposite. That is a fact. When that boy will be executed it is over for him and the unhappy father will live with the memory of that horrible crime to his own death. There is no aftermath justice with a punishing God. That would be quite ok, but alas noone knows. Who made him take drugs...certainly not you and not me. But someone did and there is always a fist time. Drug addicted people are sick, drugs changes their personnality...this is not a playdoyer for mercy. He deserves his penalty, I never said anything different. But in my long career I have seen so many cases that my judgment tends to a non emotional approach. Again I do understand your point of view and certainly as Superia said I would not hug him and congratulate him for what he has done. The crime was vile and very vicious and I condemn this as severely as you all do. I just refuse to have a medieval approach to it. Of course his death will be clean and that is never the case with the victims....but all this in the name of our civilized minds we cannot take into consideration. As for the eye for a eye mentally (which you personnally did not mention) we should have a look around and see what thhat mentality has provoked, and endless chain of misery and wars....I hope that you understand and respect my point of view as much as I try to do the same.
